These terms govern your use of www.arcusscale.com. They are terms of use for a website, not terms of service for a product: nothing is sold here, no account is created, and no payment is taken.
1 Accepting these terms
By using this website you agree to these terms. If you do not agree with them, please do not use the site. ArcusScale may change these terms at any time; the date at the top of this page records when they were last changed, and continuing to use the site after that date means accepting the version then published.
2 What this site is
This is a marketing and informational website. It describes the services ArcusScale offers, the work it has done and the people who do it. It does not provide technical, legal, financial or professional advice, and nothing on it should be relied on as a substitute for advice given about your own circumstances.
Content is published as accurate at the time of writing. Technology, pricing and the specifics of any engagement change; we do not undertake to keep every page current.
3 Results and case studies are past outcomes, not promises
Pages such as Client Results describe work ArcusScale has completed and the outcomes it produced for those clients, including specific figures for cost, performance and timelines. Those figures are historical records of particular engagements, under those clients' particular conditions.
They are not a forecast, a guarantee, a benchmark or a representation of what any other engagement will achieve. No result described anywhere on this site is offered as a commitment, and no part of this site forms an offer, a proposal or a statement of work.
4 Contacting us does not create an engagement
Emailing info@arcusscale.com, calling +1 (330) 989-8008, or booking a call through the scheduling page starts a conversation. It does not create a contract, a consulting relationship or any obligation on either side, and it does not make anything you send confidential.
Please do not send confidential, proprietary or personally sensitive information through those channels. If we go on to work together, a signed agreement governs the engagement (including confidentiality), and it supersedes anything on this site.
5 Intellectual property
The content of this site (text, images, page design, diagrams, case studies and the underlying code) belongs to ArcusScale or is used with permission, and is protected by copyright and other intellectual property law. The ArcusScale name, logo and tagline are marks of ArcusScale.
You may read, print and share pages for your own reference or to tell someone else about us. You may not republish, resell, systematically copy or use any of it to train a model or build a competing offering, and you may not use our marks without written permission.
Client names, logos and marks appearing on this site belong to those clients.
Third-party technology logos belong to their respective owners and are shown to indicate what we work with, not to imply endorsement.
6 Acceptable use
When using this site, please do not:
Break any law, or infringe anyone's rights.
Attempt to gain unauthorized access to the site, its hosting, or any connected system.
Interfere with the site's availability, including by overloading it.
Scrape, crawl or harvest content at a scale or rate that burdens the service, or in defiance of robots.txt.
Misrepresent your identity or affiliation, or use the site to send unsolicited commercial messages.
7 Links and embedded services
This site links to services we do not control (a scheduling page, a review profile, a social network) and embeds a scheduling widget. Following a link or using an embed puts you under that provider's terms and privacy policy, not ours. We are not responsible for their content, availability or practices.
8 No warranty
This site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that its content is complete or current.
9 Limitation of liability
To the fullest extent the law allows, ArcusScale and its directors, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data, business or goodwill, arising from your use of (or inability to use) this site, however caused.
Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
10 Governing law
These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law rules. The state and federal courts located in Mecklenburg County, North Carolina have exclusive jurisdiction over any dispute arising from them, and you consent to that jurisdiction.
If any part of these terms is held unenforceable, the rest remains in force.

Privacy Policy

What this website collects, who processes it and how to reach us about it. This policy covers the website only. Information handled inside a client engagement is governed by the agreement for that engagement, not by this page.
1 The short version
This site has no contact form, no login, no shopping cart and no comment thread. There is nowhere on it to type your name. The information that reaches ArcusScale comes from five places: analytics about how pages are used, a recording of your visit to this site, advertising tags that let our adverts find you again on other sites, the details you enter if you book a call through our scheduling provider, and the ordinary server logs that any website produces.
The analytics and the advertising both run only if you agree to them. The bar you were shown on your first visit is the whole of that choice, and Cookie settings at the foot of every page changes it.
2 What is collected, and how
Each mechanism below is the whole of it. If something is not listed here, this site does not do it.
Analytics. Google Tag Manager loads on every page you have agreed to it on, and through it Google Analytics. It records pages viewed, approximate location derived from IP address, referring site, device and browser, and how long a visit lasts. The tag is deliberately loaded after the page has finished rendering, so it never delays what you came to read.
Product analytics and session recording. PostHog is loaded by this site directly, rather than through the tag container, and it does two things. It records which pages you visit and what you click, so we can see whether the site leads anywhere useful. It also records the visit itself, as a playback of the pages as they appeared to you and where your cursor went, so we can watch where people get stuck. Anything typed into a field is masked before it leaves your browser, and the booking form is inside Calendly's own frame, which a recorder cannot see into at all. Like everything else here, none of it happens unless you agreed to cookies.
Advertising. The same tag container also loads advertising tags: Google Ads, StackAdapt, Taboola and Outbrain. These record that you visited, and give each network an identifier for your browser, so that ArcusScale adverts can be shown to you later on other websites. They do not receive your name or your email address, because this site never asks for either. Nothing in this paragraph happens unless you agreed to cookies.
Scheduling. The Schedule a Call page embeds Calendly. If you book, you give Calendly your name, your email address and a meeting time, and anything you choose to write in the booking notes. Calendly passes that to us so the meeting can happen. Loading the page alone does not book anything or send us your details.
Hosting and delivery. The site is served as static files from Amazon Web Services. Its infrastructure records standard request logs (IP address, time, the file requested, user agent), which exist to deliver pages and to spot abuse.
Email and phone. If you email or call us directly, we hold what you send, for as long as the correspondence is useful.
3 What is not collected
This site does not ask you to create an account, does not take payment, and does not host a contact form. The form that once posted inquiries to us was removed, along with its backend. We do not sell personal information, and no money is paid to us for any of it.
We do share it for advertising. The tags described above hand an identifier for your browser to Google, StackAdapt, Taboola and Outbrain so that our adverts can find you again elsewhere, which California law calls sharing for cross-context behavioral advertising whether or not anyone is paid. Declining cookies stops it, and so does a Global Privacy Control signal.
4 Why
Analytics tells us which pages are actually read and where visitors arrive from, so the site can be made more useful. Session recordings exist to answer the question analytics cannot, which is why a visitor stopped rather than merely that they did. Advertising exists so that a company that looked at this site once can be reminded of it. Scheduling data exists so a meeting can be arranged and honored. Server logs exist to serve the site and keep it secure. Correspondence is kept so we can answer you and remember the conversation.
Where a legal basis is required: analytics and advertising rest on your consent, which is what the cookie bar asks for and what Cookie settings withdraws. The information you enter to book a call rests on taking steps at your request before entering a contract. Server logs and correspondence rest on our legitimate interest in operating the site and answering you.
5 Who else processes it
We use third-party services rather than running these ourselves. Each is an independent company with its own privacy policy, and each holds the data described:
Google (Tag Manager, Analytics and Google Ads): site usage, the identifiers behind it, and the advertising audiences built from them.
PostHog (US region): pages viewed, clicks, and the session recordings described above.
StackAdapt, Taboola and Outbrain: an identifier for your browser and the fact that you visited, used to show you our adverts on other sites.
Calendly: the name, email address and meeting details you enter when booking.
Amazon Web Services: hosting and content delivery, and the request logs that come with it.
6 Cookies
The cookies on this site come from the third parties described above, not from the site itself, which sets none of its own. This is the whole list:
_ga, _ga_4RWPZC0Q4Y (Google Analytics, through Google Tag Manager): a randomly generated visitor identifier, used to tell a returning visit from a new one. Kept 400 days.
_gcl_au, IDE, test_cookie (Google Ads and DoubleClick, through Google Tag Manager): linking a visit to an advertising campaign, so that ArcusScale adverts can be shown to you on other sites. Kept 90 days, and 400 days for the DoubleClick identifier.
sa-user-id, sa-user-id-v2, sa-user-id-v3 (StackAdapt, through Google Tag Manager): an advertising identifier, used to show you ArcusScale adverts elsewhere after you have visited. Kept 365 days.
t_gid, t_pt_gid, taboola_session_id (Taboola, through Google Tag Manager): the same, for Taboola's advertising network. Kept 365 days, and the length of the visit for the session cookie.
dicbo_id (Outbrain, through Google Tag Manager): the same, for Outbrain's advertising network. Kept about 30 minutes.
ph_*_posthog, __ph_opt_in_out_* (PostHog, loaded by this site): an identifier for your browser, used to join your page views into one visit and to record that visit for playback. Kept 365 days.
__cf_bm, _cfuvid (Calendly, on the Schedule a Call page only): keeping the booking widget working and separating automated traffic from people. Kept 30 minutes, and the length of the visit.
7 Your choice about cookies
None of these are necessary for the site to work, so you are asked before they are set and you can change the answer at any time. Cookie settings, at the foot of every page, reopens the question.
What you are asked depends on where you appear to be. In the United Kingdom and the European Economic Area nothing analytical loads until you accept, and declining leaves it that way. Elsewhere the analytics tags run on arrival and declining stops them, which is the reading United States privacy law takes. The signal is your browser's own time zone: it never leaves your device, and no location service is consulted.
The answer itself is kept in your browser's local storage rather than in a cookie, so it is never sent to us or to anyone else. Clearing your browsing data clears it, and you will be asked again.
The booking calendar on the Schedule a Call page is treated the same way. Where cookies have not been agreed to, it is replaced by a button that loads it, so the calendar reaches you only when you ask for it.
Every browser can also block or delete cookies outright, and blocking them does not stop this site working: nothing here depends on one. You can opt out of Google Analytics specifically with Google's browser add-on.
8 How long it is kept
Session recordings are kept for 30 days and are then deleted by PostHog automatically. Analytics is retained on Google's and PostHog's schedules for their respective projects, in aggregate. Booking records and email correspondence are kept for as long as they remain useful to the relationship, and are deleted on request. Server and CDN logs are short-lived, on the provider's default retention.
9 Your rights
Depending on where you live, you may have the right to ask what personal information we hold about you, to get a copy, to have it corrected or deleted, to object to or restrict how it is used, and not to be discriminated against for asking. Residents of California, of other US states with privacy statutes, and of the UK and EEA have these rights by statute; we will honor a request regardless of where you are.
To make a request, email info@arcusscale.com and say what you would like. We do not charge for this, and we will not ask for more information than we need to find your records. If we cannot act on a request, we will tell you why.
10 Do Not Track and Global Privacy Control
There is no agreed standard for how a website should answer a Do Not Track header, and this site does not respond to one.
Global Privacy Control is different, because this site does share personal information for advertising and that is exactly what the signal asks us to stop. A browser sending it is treated as having declined cookies, and no analytics or advertising tag is loaded. You do not have to press anything on the bar for that to hold.
11 Children
This site is aimed at businesses and is not directed at children under 13. We do not knowingly collect information from them. If you believe a child has given us information, write to info@arcusscale.com and we will delete it.
12 International visitors
ArcusScale operates from Charlotte, NC. If you use this site from outside the United States, the information described above is processed in the United States and in the other countries where our providers operate, under different data protection law from your own.
13 Changes to this policy
When what the site does changes, this page changes with it, and the date at the top records when. A change that materially affects how information is used will be described here rather than made quietly.
